HPD violations run on deadlines that don’t wait for you

Housing Preservation and Development issues violations against residential buildings for housing maintenance code conditions, and unlike most agency violations, HPD attaches a certification deadline to each one based on how hazardous the condition is.

  • Class A — non-hazardous. 90 days to correct and certify.
  • Class B — hazardous. 30 days to correct and certify.
  • Class C — immediately hazardous. 24 hours to correct, with certification following.
  • Class I — information orders. Typically tied to registration and required filings.

Miss a certification window and HPD can re-inspect, add fees, and in some cases perform the repair itself and bill the owner. On buildings with multiple open violations, this escalates quickly.

And the damage doesn’t stay inside HPD. Open HPD violations can hold up your permitting with the Department of Buildings, and in some cases they freeze the rent you’re owed — you cannot collect until the conditions are corrected and dismissed. Vacate orders and the shelter bill nobody warned you about

A vacate order is usually issued against an illegal conversion, or against a property that has taken fire or water damage. HPD moves the displaced tenants out — typically to the Red Cross first, and then, after a few days, into one of the City’s shelter placements, which in practice are often private hotels.

The owner is billed monthly for that placement. And the lien frequently isn’t recorded for months, which means it does not show up on a title search run at the wrong moment. Buyers and sellers regularly end up holding someone else’s hotel bill. These run into the tens of thousands of dollars.

What we handle

Full violation audit. We pull everything open on the building — including violations from prior ownership, which transfer with the property.

Correction coordination. Getting the actual condition fixed, whether that’s a licensed plumber, an electrician, a mold remediation contractor, or a general repair.

Certification of correction. Filed on time, in the correct format, with the documentation HPD requires. Late or incorrect certifications are a leading cause of violations staying open on buildings the owner believes are clean.

Dismissal requests. Where a violation was issued in error, was already corrected before issuance, or does not apply to the cited unit.

Property registration. HPD requires annual registration for most multiple dwellings. An unregistered building cannot certify violations and cannot sue for nonpayment of rent — this stops owners more often than they expect.

Vacate order and shelter-billing searches. Run before a purchase, so an unrecorded shelter lien doesn’t become your problem after closing.

Emergency and Class C response. Immediately hazardous conditions need same-day action. Call rather than email.

HPD violations and building sales

Open HPD violations show up on title, and on residential buildings they show up in volume. A building with dozens of open Class A violations reads to a buyer’s counsel as deferred maintenance and to a lender as risk, even when the underlying conditions were fixed years ago and simply never certified.

Frequently asked questions

I already fixed the condition. Why is the violation still open? Because HPD requires certification, not just repair. Until a certification of correction is filed and accepted, the violation stays on the record no matter how long ago the work was completed. This is the single most common situation we’re called about.

Can I certify violations myself? Registered owners can certify through HPD’s online system. The obstacles are usually the registration being lapsed, the certification window having closed, or the certification being filed against the wrong violation number.

What happens if I miss the deadline? HPD may re-inspect and, for certain conditions, perform the work through its emergency repair program and bill the owner — those charges become a lien against the property.

Do HPD violations transfer when I buy a building? Yes. They attach to the property. Confirm what’s open before you close, not after.

I received a vacate order. Am I responsible for housing the tenants? In most cases the City places them and bills you monthly, and that billing can accrue for a long time before it is recorded as a lien. There is a procedure to end your responsibility as of a stated date. The sooner it is started, the smaller the bill.

Is HPD the same as DOB? No. HPD covers housing maintenance conditions in residential buildings. DOB covers construction, permits and building systems. A single building can carry both. More on DOB violations.
